Terms & conditions for membership of Wesleyan's Retirement Club

1. What do these Terms cover?

The below terms and conditions (Terms) apply to the membership of the Retirement Club (the Club) and the use of Retirement Hub (the Hub).

2. Who’s this agreement between?

These terms and conditions apply between the person who has registered to be a member of the Club and use the Hub (you) and Wesleyan Financial Services Limited (us, we or Wesleyan).

Important notice

By being a member of the Club and accessing the Hub, you agree to these terms which will bind you. The terms include limitations on liability (condition 9 below). If you do not agree to these terms, you agree to cease your membership of the Club and stop accessing the Hub immediately. Information on how to opt out of receiving communications or materials relating to the Hub is contained in condition 10 of these terms.

3. Membership of the Club

You may only access the Club in one of the following ways:

  • Existing members of the My Wesleyan Portal (the Portal) are able to register their interest in becoming a member of the Club by toggling into the Club on the My Details page (where enabled). You will then receive a Welcome email to your registered email which will include a link to access the Hub.
  • Individuals who are existing Wesleyan customers but have not yet registered for the Portal will need to register for the Portal in the first instance. Individuals can then register for the Club by toggling into the Club on the My Details page (where enabled). You will then receive a Welcome email to your registered email which will include a link to access the Hub.
  • For non-existing customers of Wesleyan, individuals will be directed to submit their details to register for the Club via an online data capture form. A link to this form can be found on relevant communications from Wesleyan including social media posts/material, through an existing partner of Wesleyan, through the Wesleyan.co.uk site or by selective other means. Once the form is submitted you will then receive a Welcome email to your registered email which will include a link to access the Hub .
  • Individuals may also be registered for the Club with their agreement by their Wesleyan Financial Adviser or customer support representative.

The Club is only intended for those with access from within the United Kingdom. For this reason, we cannot guarantee that the Club, Hub or any accessed information complies with or is appropriate for use in other places.

Any personal information you provide to us as part of the registration process for the Club will be processed in accordance with our privacy policy.

As a member of the Club, you will be provided with access to the online Hub, which shall comprise educational material, tools and resources (including but not limited to articles, live events, webinar content and guides) aimed at those in pre-retirement, at retirement and in retirement stages.

The content on the Hub is provided for general information only. It is not intended to amount to advice on which you should rely. Nothing within the Hub should be construed as being personalised financial, investment or professional advice, or shall be deemed to constitute the offer or provision of such advice.

4. Security

You are responsible for ensuring information shown or stored on your devices is kept secure. The access link for the Hub that is sent to your email is yours alone. You must not forward this or disclose to any other individual.

5. Use of the Hub

  • You may view, use and display the Hub on the Devices for your personal purposes only.
  • You will be deemed to have accepted the terms of use contained herein by accessing the Hub on any device.
  • You are responsible for ensuring your device is capable of supporting the Hub.
  • Except as expressly set out in these Terms or as permitted by any local law, you agree:
    • Not to copy or reproduce the Hub in part or in full;
    • Not to rent, lease, sub-license, loan, translate, merge, adapt, vary or modify the Hub;
    • Not to make alterations to, or modifications of, the whole or any part of the Hub, or permit the Hub or any part of it to be combined with, or become incorporated in, any other programs.
    • Not to provide or otherwise make available the Hub in whole or in part (including object and source code), in any form to any person;
    • Not to carry out any reverse engineering of the Hub;
    • Not to use the Hub on any device or operating system that does not have supported or warranted configurations; and
    • Not to use the Hub on a device which is 'jailbroken' or 'rooted', jailbroken or rooted meaning a device which has had the limitations set by your mobile service provider and/or the phone manufacturer removed without their approval.

6. Acceptable use restrictions

You must not:

  • Use the Hub in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the Hub or any operating system;
  • Infringe our intellectual property rights or those of any third party in relation to your use of the Hub;
  • Transmit any material that is defamatory, offensive or otherwise objectionable to Wesleyan in relation to your use of the Hub;
  • Use the Hub in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users and/or interfere with the operation of the Hub; and
  • Collect or harvest any information or data from the Hub or attempt to decipher any transmissions to or from the servers running the Hub or disassemble or modify any of the software, coding or information comprised in the Hub.

7. Intellectual property rights

  • You acknowledge that all intellectual property rights in the Hub, anywhere in the world belong to us and that you have no rights in, or to, the Hub, other than the right to use in accordance with the terms of these Terms.
  • The copyright in the content and material contained on, in, or available through the Hub including without limitation all information, data, text, photographs, graphics, or other materials and the selection and arrangement thereof, and all source code, software compilations and other material (Material) is owned by Wesleyan or its affiliates. All rights are reserved. You do not have any right, interest or title in or to the Material unless otherwise expressly indicated.
  • The trade marks, service marks, and logos (Trade Marks) contained on or in the Hub are registered and/or owned by or licensed to Wesleyan or its affiliates and may not be reproduced without our express written permission.
  • You may not reproduce part or all of the contents of the Hub in any form unless it is for personal, non-commercial use and you do not remove any intellectual property notices including copyright notices.
  • Except as specifically authorised above, you may not copy or otherwise incorporate into or store in any other app, website, electronic retrieval system, publication or other work any of the Material in any form (whether hard copy, electronic or other).
  • Save as expressly stated or as necessary to view, print or download extracts of the Material for personal and non-commercial use, none of the Trade Marks or Material may be copied, edited, varied, reproduced, published, displayed, distributed, stored, transmitted, commercially exploited or disseminated in any form whatsoever without the prior written consent of Wesleyan.
  • You acknowledge that you have no right to have access to the Hub in source-code form.

8. Links to third-party sites

  • The Hub may include links to other websites which are not owned, operated, or controlled by us (Third Party Websites). We provide you with such links solely for your convenience. The inclusion of such links does not mean or imply that we endorse the Third Party Websites, their availability or contents or any agreement or understanding you enter into with a third party through a Third Party Website.
  • We do not accept any liability for any loss, damage, expense, costs or liability whatsoever incurred by you in respect of these Third Party Websites.

9. Limitations of liability

  • You acknowledge that the Hub has not been developed to meet your individual requirements, and that it is therefore your responsibility to ensure that the facilities and functions of the Hub meets your requirements.
  • We only supply the Hub for domestic and private use. You agree not to use the Hub for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • We are not responsible for any loss or damage beyond our control. Loss or damage may be beyond our control because:
    • There is a failure of public or private telecommunications networks;
    • It relates to how your device works;
    • You cannot access the Hub for any reason or they are slow;
    • Any device, hardware or software you use with the Hub is damaged or corrupted or does not work;
    • The Hub does not meet your requirements, are not what you expect or contain errors or defects or we do not correct these;
    • We are prevented from providing the Hub in part or in full because of something which a third party does.
  • We can give no warranty that the Hub is free of viruses or can be used with any computer, software or browser systems.
  • We exclude all implied conditions, warranties, representations or other terms that may apply to our Hub or any content on it.
  • We do our best to ensure that the information on the Hub is accurate and helpful at all times. However, we cannot guarantee this. It is your responsibility to check that any such content is accurate, complete and up to date. We will not be liable to you (or anyone else) for any loss or damage (including consequential loss) suffered in connection with the content provided on the Hub or any use or reliance you may make of or put on it. Any of the material on the Hub may be out of date at any given time, and we are under no obligation to update such material.

We do our best to ensure that the Hub shall operate properly at all times, but we make no warranties as to the availability of the Hub, and (save as otherwise set out in these Terms and Conditions) we will not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of the Hub. We may, at our absolute discretion, suspend, withdraw or restrict the operation of the Hub where we consider it necessary. For example (but without limitation), suspension may be necessary for technical reasons, emergencies or regulatory reasons.

  • Nothing in these Terms shall limit or exclude our liability for:
    • Death or personal injury resulting from our negligence;
    • Fraud or fraudulent misrepresentation; and
    • Any other liability that cannot be excluded or limited by English law.

10. Consent

  • Members who have signed up to the Club will receive emails on a monthly basis (or as such other frequency as we determine from time to time) from us with updates of the information available on the Hub or other material relating to the Hub (Hub Materials).
  • Members can opt-out of receiving Hub Materials (including any email updates) in connection with the Hub, by accessing the opt-out link which is featured in the bottom of every email communication.  Portal users can opt-out of receiving Hub Materials by toggling to opt-out of Retirement Club on the My Details page (where this is enabled).

11. Variation/Termination

  • There is no minimum contract period, and you may stop being a member of the Club at any time. To stop receiving Hub Materials, you can opt-out of receiving these communications through one of the methods set out in condition 10 above of these Terms. You acknowledge that it is your responsibility to cease accessing the Hub.  
  • Unless we are unable to contact you or there are reasons beyond our control preventing us from contacting you, we will use reasonable endeavours to give you notice before taking action to suspend, withdraw or restrict your membership of the Club and/or use of the Hub. If we are unable to contact you before any such action is taken, we will send notice to you, if possible, afterwards.

We may suspend, withdraw or restrict your membership of the Club and/or use of the Hub or any part of the Hub where:

  • We have reasonable grounds to suspect that your security details have not been kept safe, or have reasonable grounds to suspect that your security details have been used without your authority, or fraudulently;
  • We consider it appropriate for your protection; or
  • We discontinue the whole or any part of the Hub.

We may terminate your access immediately on the following:

  • If you commit a material or persistent breach of these Terms which you fail to remedy (if remediable) within 14 days after the service of written notice
  • You breach any of the Acceptable Use Restrictions (paragraph 6 above) or the Security provisions in paragraph 4;
  • If you cancel your access to the Hub.

On termination for any reason:

  • All rights granted to you under these Terms shall cease;
  • You must immediately cease all use of the Hub.

We may revise these Terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on the Hub. 

12. Uploading feedback to the Hub

  • Whenever you make use of a feature that allows you to upload feedback to the Hub, you must comply with the content standards set out in paragraph 6 (Acceptable Use Restrictions).
  • Any feedback you upload to our Hub will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose.
  • We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Hub.

13. Privacy policy

If you provide information to us on or through the Hub, we will use it in accordance with the terms of our privacy policy. That privacy policy forms part of these Terms and by using the Hub you acknowledge and agree that you accept the terms of that privacy policy.

    14. Communication between us

    • All communication between us will be via email unless you request otherwise.
    • If you wish to contact us in writing, or if any condition in these Terms requires you to give us notice in writing, you can do by post: Wesleyan Financial Services, Colmore Circus, Birmingham B4 6AR, or email mywesleyan@wesleyan.co.uk. We will confirm receipt of this by contacting you in writing, normally by e-mail.
    • If we have to contact you or give you notice in writing, we will do so by e-mail to the personal e-mail address or by post to the address which you have provided to us or by post to the address you have provided to us.

    15. Other Important Terms

    • We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms.
    • If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
    • Each of the conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
    • Please note that these Terms, its subject matter and its formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
